Terms of Use

The short version. Momo is a subscription app with a 3-day free trial. It renews automatically unless you cancel through the App Store or Google Play at least 24 hours before the period ends. Coins and characters are earned in-app, have no cash value, and cannot be bought with real money or transferred out. Don't cheat the leaderboard, and don't be unpleasant to other people in rooms.

These terms are an agreement between you and [Legal entity] ("we", "us") covering your use of Momo: Pomodoro Gamified ("Momo", "the app"). By downloading or using Momo you accept them. If you don't accept them, don't use the app.

1. Who can use Momo

You must be at least 13 years old. Some countries set a higher age for agreeing to an online service without a parent; where that applies to you, that age is the minimum instead. If you are under the age of majority where you live, you need a parent or guardian's permission. You are responsible for keeping your sign-in details secure and for everything that happens on your account.

2. Subscription, trial and billing

Momo is subscription-only. After the trial, an active subscription is required to use the app.

Free trial. New subscribers get 3 days free. If you cancel before the trial ends you are not charged. Trial eligibility is determined by Apple or Google, and is generally offered once per person.
Plans. Momo offers a monthly and a yearly plan. The current price, in your local currency, is always shown in the app before you confirm.
Automatic renewal. Your subscription renews automatically at the end of each period unless you cancel it at least 24 hours before that period ends. Your store account is charged within 24 hours of the period ending.
Cancelling. Cancel any time in your App Store or Google Play account settings, or through Profile → Subscription → Manage in the app. Cancelling stops future charges; you keep access until the current period ends. Deleting the app does not cancel your subscription.
Refunds. Purchases are processed by Apple and Google, so refunds are governed by their policies and handled by them. We can't issue store refunds directly, but tell us if something went wrong and we'll help where we can. Where consumer law gives you a statutory right to a refund, that right is unaffected by anything here.
Price changes. If we change the price of your plan we will give you notice, and the new price only applies after your current period ends. Apple and Google will ask you to confirm before charging a higher amount.

3. Coins, characters and other virtual items

Coins are earned by completing focus sessions. They cannot be purchased with real money, and there are no coin packs or loot boxes.
Coins, characters, pets, accessories, badges, XP and levels are a limited, personal, non-transferable licence to use them inside Momo. You do not own them, they are not property, and they have no monetary value outside the app.
You may not sell, trade, gift or transfer them, or your account, to anyone else, and you may not exchange them for real money or anything of value.
We may adjust prices, rewards and drop rates to keep the game balanced, and we may correct balances that were awarded in error or obtained by cheating. If we retire an item you own, we will replace it or credit you fairly.
Coins and items are forfeited when an account is deleted, and are not refundable.

4. Fair use

You agree not to:

falsify sessions, XP, coins, streaks or leaderboard position — by modifying the app, automating it, using emulators or bots, tampering with your device clock, or exploiting bugs;
choose display names, character names or room names that are hateful, harassing, sexual, deceptive or that impersonate someone else;
harass other users, or use rooms, invites or friend requests to spam or abuse people;
reverse engineer, decompile or attempt to extract source code from the app, except where the law expressly permits it;
probe or interfere with our infrastructure, circumvent rate limits or app attestation, or access another user's account or data;
use Momo to break any law, or in any way that infringes someone else's rights.

We can suspend or terminate accounts that break these rules, and reset progress that was obtained unfairly. Where it's reasonable to do so we'll warn you first and explain why.

5. Strict Mode and other device features

Strict Mode (iOS) asks Apple's Screen Time system to block the apps you choose for the length of your session. It is a tool to help you, not a security control: it depends on the operating system, it can be turned off in your own device settings, and it may not block every route to a distraction. Notifications, Live Activities and background timers likewise depend on your device, its settings and its battery state. We can't promise any of these will work perfectly on every device.

6. Our content and yours

Momo, including its characters, artwork, sprites, sounds, copy and code, belongs to us or our licensors and is protected by copyright and trade mark law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use. You keep whatever rights you have in the content you enter — display names, character names, session labels, room names — and you grant us the licence we need to store it, show it to the people you share it with, and operate the app.

7. Availability and changes

We're building Momo actively, so features may be added, changed or removed. We may need to interrupt the service for maintenance, and connected features such as co-focus rooms, presence and the leaderboard need a working internet connection. Solo sessions are designed to work offline and sync afterwards. If we discontinue Momo entirely we will give reasonable notice and, where you have paid in advance for a period you can no longer use, a pro-rata refund through the relevant store.

8. Momo is not health advice

Momo is a focus timer with a game around it. It is not a medical device and is not intended to diagnose, treat or manage any condition, including ADHD. It doesn't guarantee productivity. Talk to a qualified professional about health decisions.

9. Disclaimers and liability

To the fullest extent the law allows, Momo is provided "as is" and we don't warrant that it will be uninterrupted, error-free, or that data will never be lost. We are not liable for indirect, incidental, special or consequential losses, or for lost profits, lost data, lost coins or lost streaks. Where we are liable, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or fraud. If you are a consumer, you keep all the statutory rights your local law gives you, and nothing here overrides them.

10. Ending this agreement

You can stop at any time by cancelling your subscription and deleting your account from Profile → Delete account. We may suspend or end your access if you materially break these terms, if we're required to by law, or if we discontinue the app. When the agreement ends, your licence to use Momo ends with it; the sections on virtual items, disclaimers, liability and governing law survive.

11. Apple and Google

These terms are between you and us, not with Apple or Google. Apple and Google are not responsible for Momo, and they have no obligation to provide support for it. If Momo fails to conform to any warranty Apple is required to give, you may notify Apple and Apple will refund the purchase price, if any. Apple and Google are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US embargo, and are not on any US prohibited-party list.

12. Changes to these terms

We may update these terms. We'll change the date above, and for material changes we will tell you in the app before they take effect. Continuing to use Momo after that means you accept the new terms; if you don't, cancel and delete your account.

13. Governing law

These terms are governed by the laws of [Country/State], and its courts have exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country's law and may bring proceedings there.
